Redundancy or Unfair Dismissal?

Notwithstanding the economic turmoil Ireland has and is experiencing – where redundancies are inevitable, employers must be able to show that a genuine redundancy situation exists. The case of JVC Europe Limited v. Ponisi demonstrates the risk employers face when they attempt to disguise a dismissal as heavy penalties can follow where a dismissal is found to be unfair.
